Payments Generally

These Terms and Conditions apply to payments made to Clifford James Consultants Limited and/or its clients.

By making a payment to Clifford James Consultants Limited and/or a client of Clifford James Consultants Limited (“client”), you accept these Terms and Conditions in addition to and as forming part of any agreement made between Clifford James Consultants Limited and/or its client and you, unless expressly stated otherwise by Clifford James Consultants Limited and/or a client. In the event that no agreement has been made between Clifford James Consultants Limited and/or a client, these Terms and Conditions will apply to any payment you make to Clifford James Consultants Limited and/or a client for that transaction only and without prejudice to any rights or claims Clifford James Consultants Limited and/or a client may have against you. You accept and agree that these Terms and Conditions in no way affects any outstanding case, claim, right or other matter Clifford James Consultants Limited and/or a client may have against you and in all circumstances is without prejudice to any rights or claims Clifford James Consultants and/or its client may have.

If you send a cheque to Clifford James Consultants Limited and/or a client that is not honoured, we will charge you an administration fee of £30.00 plus VAT, representing the reasonable cost and charges that are incurred in these circumstances. If you send a BACS payment or bank transfer to Clifford James Consultants Limited and/or a client for an amount that is not agreed, the payment will not constitute a settlement and if this payment is not received by Clifford James Consultants Limited and/or its client on an interim basis, the payment will be returned to you less an administration fee of £30.00 plus VAT. This represents the reasonable cost and charges that are incurred for processing this transaction.

In all circumstances, any payments received by Clifford James Consultants Limited and/or its client are strictly received an interim basis only and without prejudice to any outstanding matters, claims, heads of claim or rights, unless expressly agreed otherwise. Nothing in these Terms and Conditions will affect any individual agreement or settlement and at all times is without prejudice to any rights or claim.
