Clifford James Consultants have successfully represented a client who owns an Aston Martin DB4 Series 5, which lost £20,000.00 following a road traffic accident.
The rare and uncommon 1963 Aston Martin DB4 Series 5 Vantage, was structurally damaged when it suffered a rear end shunt pushing it into another vehicle in front. The repairs cost in excess of £114,000.00.
Despite the serious nature of the damage and the extent of the repairs required to fix the Aston Martin, the third party insurance company disputed the diminution case on grounds that repairs were carried out to a good standard. In response Clifford James Consultants applied the law, which confirms that diminution arises despite good quality repairs.
Taking into account the strong arguments put forward by Clifford James Consultants, the third party insurance company conceded that the Aston Martin had lost value and settled the claim without the need for a trial.
The result was a settlement at £20,000.00 for the diminution in value of the Aston Martin.
